In the name of God, Amen, I ZILPAH YANCEY of the county of Caswell and state of North Carolina being sound in mind, but in feeble health and conscious of the uncertainty of life and the certainty of death do make and constitute this my Last Will & Testament.

First - I give and bequeath unto my daughter MILDRED ANN YANCEY two young negroes - one boy John aged eleven and Mary a girl aged three years.

Second - I give and bequeath to my son ALBERT G. YANCEY two hundred dollars in money.

Third - I give to my granddaughter MARY ELIZABETH YANCEY GUNN - daughter of James Gunn one hundred and fifty dollars in money.

Fourth - It is my will and desire that after the payment of the above named special legacies the balance of my estate shall be equally divided between my three children: ALBERT G. YANCEY, WILLIAM YANCEY, AND MILDRED ANN YANCEY.

Fifth - It is further my will and desire that if my daughter MILDRED ANN should die without any lawful heirs of her body that the property herein willed to her shall be equally divided between my two sons: ALBERT G. YANCEY & WILLIAM YANCEY.

Sixth - It is furthermore my will & I do hereby constitute and appoint my son ALBERT G. YANCEY trustee to take possession of and manage to her benefit the sum of one hundred fifty dollars which I give unto my granddaughter MARY ELIZABETH YANCEY GUNN and should she die without a lawful heir of her body. It is my will that the same shall be equally divided between my three children: ALBERT G. YANCEY, WILLIAM YANCEY, & MILDRED ANN YANCEY or such of them as may be living at the time of the death of my said granddaughter.

Seventh - It is my desire that if it is practicable that my negroes should not be sold but valued by some disinterested persons & divided (such of them as are not specially disposed of by the second clause of my will) after the payment of the special legacy named above - equally between my three children: ALBERT YANCEY, WILLIAM YANCEY & MILDRED ANN YANCEY as heretofore directed - provided it can be equitably and satisfactorily done.

Eighth - I give and bequeath to my daughter MILDRED ANN YANCEY - a set of silver tablespoons and a set of silver teaspoons now in my possession. I also give her bed clothing enough to furnish a bed such as she may select from amongst such as I have.

Ninth - I hereby constitute and appoint my two sons ALBERT G. YANCEY & WILLIAM YANCEY my Executors to this my Last Will & Testament - In testimony whereof I have hereunto set my hand and affixed my seal this 28th day of March 1843.
