In the name of God, amen, I NATHAN YANCEY of the county and Parish of Elizabeth City do make and ordain this to be my Last Will & Testament in the manner & form following:

I give unto my Nephew NATHAN YANCEY, son of JOHN YANCEY & ELIZABETH his wife, all my Estate both real & personal to him and his heirs forever lawfully begotten of his body. If he should die without issue I give the said estate to JOEL YANCEY son of JOEL YANCEY, my brother, to him and his heirs forever. In case he dies without issue I then give the said estate to the inhabitants of the Southside of Backriver Greenland and Fox Hill for the use and benefit of a school for education of the poor children in the precinct as the trustees may think proper & that no children of Baptist parents should be allowed to go to the said school and none but thoose that are of the Protestant Episcopal Church as now or may be established.

Item - It is my will and desire that the freeholders of the above precinct, do elect or choose two members living in said precinct to be of the Potestant Episcopal church to have the sole management of the said school and to see good government thereof and they are to rent out the plantation and to hire out the negroes to the best advantage for the benefit of the said school. The master shall be obliged to attend his school from one hour by son in the morning until one hour by sun at night and that he shall be no drunkard and a member of the church aforesaid.

Item - I give unto MARTHA ELLIOTT the half of a negro fellow named Stepney, and fifty pounds out of the money due from ELISABETH MINGHAM deceased for her board which is due by [Aicomps?]

Item - My will and desire is that my Executor hereafter mentioned may follow & receive all moneies may be due me & pay all my just debts & funeral expenses.

Item - I appoint COL. JOHN [GARY?] and JOSEPH COOKER my sole Executors of this my last Will & testament and guardians to NATHAN YANCEY my Nephew when he comes of age and to manage the Estate as they may think proper for the use of the same. In witness whereof I have hereunto set my hand and seal this 19th day November 1789.

Elizabeth City County Court - April 1790 This will was produced in court which together with the codicil thereto annexed was proved by the oaths of the witnesses thereto subscribed and order to be recorded at a court held for Elizabeth City County Augsut 28 1792 on the motion of JOHN YANCEY who made oath according to law. Certificate is granted to him for attaining letters of administration of the Estate of NATHAN YANCEY decd. with this will annexed, whereupon he, together with ARCHELAUS YANCEY his [______?] entered into [_____?] bond in the [_____?] of $1,200 conditions of law directs
