I JECHONIAS YANCEY of the county of Logan do make this my Last Will & Testament.

1st - all my just debts are to be paid

2nd - I bequeath to my wife ELIZABETH all of the property I had in posesion when I married her, also my slave [Grant?] during his life, also she shall have the house that I posess in the [?] and the two fields extending from the grass land to the river on this side of the creek during her natural life. Also I give unto my wife two farm horses, [two ploughs and gear?] two cows and calves, one feather bed and furniture, one [desk?], one falling [leaf table?], my stock of sheep, [?] cupboard ware she may desire and what stock hogs she may think well to do her to have and to hold said property during her life. Also I give unto my wife one year posession of all kind.

3rd All of my lands, slaves, stock of all kind including horses, cattle, hogs, household and kitchen furniture, farming utensils, wagons, carts, bonds, notes, accounts due or to become due, also all the [___?] that I may posess that I have enumerated I bequeath this to the children of my son JAMES YANCEY and should he have any more children they shall come in for an equal share with those that are now born and living. It is [all?] also my desire that JAMES YANCEY should move and live on the farm that formerly belonged to SMITH GIBBS and that he should take the said lands and slaves, horses, cattle, hogs etc. and [___?] and educate his children well. None of my property that I may [___?] signed and possessed shall go to pay any of my son JAME'S debts that he has heretofore or that he may hereafter contract. As the children of my son JAMES and daughter it is my desie that as they grow up and marry that they should have something like their portion of property provided they married judiciously and well and should they not marry to pleae their parents it shall be in the power of my son JAMES to alot this property to them so as their [_____?] [lands cannot spend it ??] Also should any of my granchildren marry and never have any children then at their death the property they got by me shall return to their brothers & sisters.

All the property that I have bequeathed to my wife ELIZABETH during her natural life shall at her death go to the children of my son James. Also should their be any property of any kind that I have not [discussed?] and willed then it is my desire the same should go to the children of my son JAMES. The slaves that I loaned or deeded to my daughter CATHERINE I bequeath to her during her natural life and then to go to the heirs of her body.

It is my desire that my wife ELIZABETH and my son JAMES be my Executrix & Executor to this my last will and testament and that the County Court [of] Logan shall not reqire security of them. It is my desire that there should be no [appraisal?] made of my estate. I hereby revoke all former wills - witness my hand and seal this 7th Dec 1844

A codicil to my above will: Should the children of my daughter CATHERINE die before before she does, at her death the slaves that I have willed her shall return to the children of my son JAMES. I also bequeath to my daughter CATHERINE Twenty Dollars should she demand it of my Executors as witness my hand this 7th Dec 1844.
