In the name of God, amen, I ALGERNON S. YANCEY, of the county of Caswell and state of North Carolina being of sound mind and disposing memory but of feeble frame and body do make and ordain this my Last Will and Testament in manner and form following:

Item 1st - whereas I am indebted to the children of HENRY MCADEN decd. in the sum of between four and five thousand dollars after deducting the amount which they may be done me for [_____?] and whereas I am likewise indebted to NANCY YANCEY and ANN ELIZABETH YANCEY in the sum of [near?] one thousand or thereabouts which amount it is promised they will make my estate responsible for. Now in order to discharge the above mentiioned debts I provide that my friend ABISHA SLADE shall act as my executor.

Item 2nd - It is my will and desire that the ELIJAH GRAVES tract of land shall be sold by my executor - all of it up to the gate on the other side of [Ben Age Creek?] the fence crossing from the barn up to the [corner?] that was adjoining THOMAS D. JOHNSTON Esq. the prtion of land lying north of that [fence] shall belong to my estate. The remaining portions of the ELIJAH GRAVES tract I wish sold as above directed.

Item 3rd - It is my will and desire that JOHN [BENTON?] shall finish the [crop?] he has on land and that NOEL [BENTON?] shall live with my widow during the next year and that NOEL BENTON be permitted by my executor to clear as much land as to think may seem [appropriate?] in order to fill out his to fill out his tobacco crop for my present [____?]

Item 4th - It is my will and desire that [after] the expiration of this fall my Executor shal have a sale in order to sell off all the surplus [provisions?] which may be on the plantation.

Item 5th - It is also my will and desire that all the surplus corn, wheat and fodder be sold by my executor on a credit of six months at the expiration of Noel Benton's year.

It is my will and desire that ABISHA SLADE shall act as my executor he having agreed to do so for the sum of one hundred dollars. It is further my will that if the land and crops herein directed to be sold shall [____?] be sufficient to discharge my [_____?] then such negroes as shall be agreed upon by my executor and my wife HENRIETTA W. YANCEY, shall be sold at public auction on a credit of six months. It is my will and desire that all the residue of my property both real and personal and mixed shall remain in the hands of my surviving wife but should she die it is my will and desire that all the property that I have shall go to our little daughter ANN E. YANCEY [Infant?]

It is my will and desire should our child die that my wife HENRIETTA W. shall have one half of all my estate both real and personal and mixed during her natural life and at her death to be equally divided between the heirs of my body - given under my hand & seal this 27th day of August A.D. 1846.
